Please read these “site terms of use” carefully before using our website.
Customers who use this e-commerce site and make purchases are deemed to have accepted the following terms:
The web pages on our site and all pages linked to them (“site”) are owned and operated by Denge Tasarım, located at Cumhuriyet Mah. Çetin Sok. No:8 B Blok D:2-3-4 Yakacık Kartal Istanbul (“Company”). By using all services provided on the site, you (“User”) acknowledge that you are subject to the following terms, that you are over 18 years old, legally competent, and authorized to enter into contracts according to applicable laws, and that you have read, understood, and agree to be bound by these terms.
This agreement imposes rights and obligations on the parties regarding the site. By accepting this agreement, the parties declare that they will fulfill these rights and obligations completely, accurately, and on time, in accordance with the terms set forth herein.
1. RESPONSIBILITIES
a. The Company reserves the right to change prices and offered products or services at any time.
b. The Company commits that members will benefit from the contracted services, except in cases of technical failures.
c. The User agrees not to perform reverse engineering, attempt to obtain source code, or take any other actions aimed at this purpose. The User is fully responsible for any damage caused to third parties and agrees to legal and criminal proceedings if these actions occur.
d. The User agrees not to create or share content that is contrary to public morals, unlawful, infringing the rights of third parties, misleading, offensive, obscene, pornographic, violating personality rights, infringing copyrights, or promoting illegal activities. The User is fully responsible for any resulting damages. In such cases, the site administrators may suspend or terminate accounts and reserve the right to initiate legal action. They also reserve the right to provide information to judicial authorities if required.
e. Relationships between site members or with third parties are the sole responsibility of the members.
2. INTELLECTUAL PROPERTY RIGHTS
2.1. All intellectual property rights, registered or unregistered, such as titles, trade names, trademarks, patents, logos, designs, information, and methods on this Site belong to the Company or the designated parties and are protected under national and international law. Visiting this Site or using its services does not grant any rights over such intellectual property.
2.2. Information on the site cannot be reproduced, published, copied, presented, or transmitted in any way. The whole or part of the Site cannot be used on another website without permission.
3. CONFIDENTIAL INFORMATION
3.1. The Company will not disclose personal information submitted by users to third parties. This personal information includes name, surname, address, phone number, mobile phone, email address, and any other information identifying the User, collectively referred to as “Confidential Information.”
3.2. The User consents to the Company sharing its own communication, portfolio, and demographic information with affiliates or group companies solely for marketing purposes such as promotion, advertisement, campaigns, announcements, etc. This information may be used to create customer profiles, offer promotions and campaigns suitable for those profiles, and for statistical analysis.
3.3. Confidential Information may only be disclosed to official authorities when requested in accordance with legal procedures and mandatory laws.
4. NO WARRANTY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SERVICES PROVIDED BY THE COMPANY ARE OFFERED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THIS INCLUDES ALL INFORMATION PROVIDED THROUGH THE SERVICES.
5. REGISTRATION AND SECURITY
Users must provide accurate, complete, and up-to-date registration information. Otherwise, this Agreement will be considered violated, and accounts may be closed without notice.
Users are responsible for the security of passwords and accounts on the site and third-party platforms. The Company is not liable for data loss, security breaches, or damage to hardware or devices caused by failure to secure accounts.
6. FORCE MAJEURE
Neither party shall be liable for failure to perform obligations arising from this agreement due to events beyond their control, including natural disasters, fires, explosions, civil wars, wars, uprisings, public movements, martial mobilization, strikes, lockouts, epidemics, infrastructure and internet failures, or power outages (collectively “Force Majeure”). During such events, rights and obligations under this Agreement are suspended.
7. ENTIRE AGREEMENT AND VALIDITY
If any provision of this Agreement becomes partially or completely invalid, the remainder of the Agreement shall continue to be valid.
8. CHANGES TO THE AGREEMENT
The Company may partially or entirely modify the services offered on the site and these terms of use at any time. Changes take effect from the date they are published on the site. It is the User’s responsibility to follow these changes. Continued use of the services constitutes acceptance of the modifications.
9. NOTIFICATIONS
All notifications regarding this Agreement will be sent via the Company’s known email address and the email address provided by the User during registration. The User acknowledges that the registered email is valid for notifications and agrees to notify the other party in writing within 5 days of any changes. Otherwise, notifications sent to the registered email shall be considered valid.
10. EVIDENCE AGREEMENT
In case of any disputes related to this Agreement, the parties’ records, books, computer records, and fax records shall be accepted as evidence pursuant to the Turkish Code of Civil Procedure No. 6100, and the User agrees not to dispute these records.
11. DISPUTE RESOLUTION
All disputes arising from the application or interpretation of this Agreement shall be subject to the jurisdiction of the Istanbul (Central) Courthouse Courts and Enforcement Offices.
